2UE Legal Matters listener Wayne, aged 56 had been a member of a Sydney Gym for 7 years
When he joined he understood he was signing a contract with the company
to provide gym services. And in return, the $70 per month was deducted from his bank account.
When Wayne told the gym he was relocating to Queensland he was told he would have to pay three months penalty fees.
Wayne rang Tim on Legal Matters. Tim and his producers contacted the gym and got a copy of the contract.
They were in their right to charge three months penalty. But commonsense told Tim Shaw that the loyalty Wayne had to the gym and their inability
to provide alternate services in Queensland meant Wayne’s case should be an exception.
The National Marketing & Communications Manager of the gym agreed with Tim Shaw. The direct debit has stopped on Wayne’s bank account .
Tim Shaw says; “This is a case where the brand damage to the gym would have been a 1000 times worse if this matter was not handled in the sensible way that we did. It’s easy to slam a business or a brand on the radio but that would not help Wayne. Its sometimes better to get a business to talk with me and I help them to see the light and realise a simple “yes” instead of “no” is the better way to go.
